Bell 1 – Abusive interests
On October 28, 2010, Mr. Louis Aka-Trudel filed a motion for authorization to institute a class action and to be a representative against Bell Canada and Bell Mobility Inc. concerning the imposition since June 1, 2010 of a 42.58% annual interest on balances paid after the due date.
On December 16, 2011, the class action was authorized by the Honorable Judge Lucie Fournier in her judgment.
Main group:
“all natural persons and all legal persons under private law, companies or associations, counting at any time during the 12-month period preceding October 28, 2010 under their direction or under their control no more than 50 persons related to them by employment contract, residing or having resided in Quebec and who have paid since June 1, 2010 interest at the annual rate of 42.58% on the amount of at least one invoice issued by one or other of the Defendants or by the two Defendants under one of the following contracts: Terms and Conditions for Unregulated Local Telephone Services – Consumer Market; Home Internet service contract; and Bell Mobility Terms of Service; as well as under, for individuals, the Non-Regulated Terms of Service – Voice and Internet Services (Business Customers) contract.”
Consumer group:
“all natural persons, except a merchant who has entered into a contract for the purposes of his trade, residing or having resided in Quebec and who have paid since June 1, 2010 interest at the annual rate of 42.58% on the amount of ‘at least one bill issued by one or other of the Defendants or by both Defendants under one of the following contracts: Terms and Conditions for Unregulated Local Telephone Services – Consumer Market; Home Internet service contract; Bell Mobility Terms of Service; and Non-Regulated Terms of Service – Voice and Internet Services (Business Customers).”

The exercise of the collective action has been authorized. The case is following its course.
On November 30, 2016, Bell appealed the Judgment dismissing the motion for declinatory exception. The Quebec Court of Appeal hearing will be held on April 20, 2018 at the Montreal Court of Appeal.
