On September 16, 2011, the petitioner Ronald Asselin filed a motion for authorization to institute a class action and to be a representative against Fiducie Desjardins inc., Desjardins Cabinet de Services Financiers inc. and Desjardins Asset Management Inc., following the lack of return on the Perspective Plus or Active Management term savings investments following the liquidation in the fall of 2008 of the sums dedicated to performance.

All natural persons and all legal persons under private law, companies or associations, counting at any time during the 12-month period preceding September 16, 2011 under their direction or under their control not more than 50 persons who are linked to them by a employment contract, who, as at December 31, 2008, held the Perspective Plus term savings investment or the Active management term savings investment.

An appeal was lodged against the judgment refusing authorization to institute the class action. Thus, the Court of Appeal will soon render judgment and decide whether the class action can go ahead. The decision of the Court of Appeal will be available on our website as soon as it is published.
